But at least they don’t endanger lives. Not so with the boss of a West Virginia coal mine. According to fireboss, John Renner, his supervisor told him that regardless of ventilation issues, Renner was to evacuate the mine only if a federal inspector was watching.

As fire boss of Patriot Coal Corp’s Federal No. 2 Mine, Renner’s job was to monitor methane and oxygen and determine whether the methane had reached dangerous levels. Federal law requires that either the area be ventilated or the mine evacuated if levels exceed a certain reading. The government has required this type of monitoring since a 2006 methane explosion in a mine killed 12 men.

But Renner says that the first time he evacuated the mines after getting an above normal reading, foreman supervisor, Randy Coffindaffer, berated him for the evacuation, asking him “Do you know how much money you’re costing this company right now, evacuating it?” Renner says he was “cussed” and “screamed’ at and told by Coffindaffer that he was “never, ever, under any circumstances” to evacuate unless a federal inspector was present. Fearful of losing his job, Renner relented. As a result, he’s been charged with falsifying inspection reports and is expected to plead guilty Wednesday in the U.S. District Court in Clarksburg.

Renner is cooperating with authorities, and in recordings made during meetings with state officials can be heard speaking about having panic attacks, consulting with a psychiatrist and taking medication to deal with job related stress. Associated Press attempts to speak to Coffindaffer were unsuccessful and there’s no word on whether he’s still working for Patriot Coal.

Renner was obviously wrong for falsifying reports and putting miners’ lives at risks. But Coffindaffer and the management team that allowed him to bully Renner into doing it, must also be held accountable. Despite CBS’ “Undercover Boss”, I refuse to believe that most bosses are unaware when their management team is cutting corners, cheating and endangering lives. I’m just not buying it. I hope Renner’s testimony helps put Coffindaffer behind bars for a long time. Harsh? Not harsh enough if you ask me.

The Washington Examiner has the full story here.

Cheating on their wives wasn’t the only bad thing politicians and elected officials were caught doing in 2009. From judges operating above the law to mayors creating their own, 2009 was a banner year for political stupidity…

Judge Sam Kent’s law and major disorder

Just when we thought Rod Blagojevich was the biggest tool going, US District Judge Sam Kent literally and figuratively takes the title. The 6′4″, 250 pound judge is disgusting. He’s not just disgusting because he sexually harassed and tormented the female members of his Galveston, Texas courthouse for years – fondling them in the hallways, forcing one assistant’s head into his crotch and forcing his mouth unto another. And, he’s not just disgusting because he was frequently drunk on the job. Even alternately calling himself ‘the emperor of Galveston’, ‘the government’ and (insulting wildlife everywhere,) ‘the lion king’ wasn’t disgusting enough. No, Kent is disgusting and deserves the Tool of the Week award because:

In keeping with true Really Bad Boss behavior Kent first denied the sexual assaults claiming that the sexual contact was consensual. When he finally confessed, it was in a plea bargain that gave him a 33 month prison sentence for obstruction with the sexual misconduct charges being completely dropped.

After initially denying the sexual assaults, Kent eventually blamed his behavior on “difficulties dealing with the death of his first wife and other issues.”

Read more about why Kent won our tool of the week award here…

This just in – Rod Blagojevich is still a tool. You know how much we love Blago right? Well today we fell in love all over again as he pleaded not guilty to 16 federal criminal charges. Blagojevich, hair perfectly in place, looked relaxed and confident as he entered his not guilty plea at the Dirksen Federal Building in Chicago. Blago said he was ”saddened and hurt…” by the indictment, and then told reporters to go f*** themselves. No, he didn’t actually say the last part, or at least he wasn’t caught on camera saying it. But when all this drama began four months ago, he was heard on tape referring to now President Obama, as a “m***** f*****,” so cursing at reporters would certainly not be out of character for him.

As you know from our ongoing love affair with Kwame Kilpatrick, the only thing we love more than a really bad boss, is a really bad boss who, even when caught on tape, still denies any wrong doing. It comes as absolutely no surprise to us that this pillar of the community continues to deny attempting to auction the, then vacant, Illinois senate seat to the highest bidder.

When Blagojevich finally does admit to some wrong doing, we’ll be sure to cover it here, along with the breaking news of pigs flying and hell freezing over.

We’re not buying it. No list that includes Rod Blagojevich is complete without Roland Burris. Burris still insists he didn’t try to buy his senate seat from Blagojevich. We didn’t believe him then, we don’t believe him now. Here’s how we saw it back in August.

A couple of weeks ago, Roland “I don’t know what the hell I’m doing” Burris, hinted at not running to retain the senate seat Blagojevich tried to sell him gave him. We all breathed a collective sigh of relief. At least I thought we did. Burris now says he might still be in the running because he’s being urged by “people all over the country” to run. What country? Which people? And by all over does he mean all over his house? Caus’ we’re not buying it.

That said, Marion Barry proved that some people could do anything and get reelected. And I guess being caught on tape negotiating the purchase of your senate seat, when compared to being caught on video smoking crack, is no big deal. Nevertheless, right now most people, besides the ones in his basement encouraging him to run, just think he’s an idiot. If by some miracle he’s actually elected to the position, we fear he’ll open his mouth one time too many and prove once and for all that he is.

What do you get when you mix two prostitutes and a former Republican party chair? A beat-down. A politician can usually talk himself out of anything…except that is, a beat-down from his wife who’s just caught him with two prostitutes. Former Cook county Republican Party chair Gary Skoien denies he was with two prostitutes at around 1:00am last Sunday. His wife begs to differ and police reports state she allegedly beat him (embellishment mine) after finding him at home in their children’s playroom with two women. Skoien claims the police report is wrong and that he’s working on correcting it. By correcting it he means denying it ever happened.

I just called the FRANKLIN POLICE DEPT., said I needed to file a complaint against Stewart Heath, after explaining who Stewart Heath was, the person said “oh yeah, you need to speak with Det. Dixon”, left vm, Franklin PD number is 615-794-2513

Thanks so much, “somemore”…I just had a wonderful conversation with the delightful Det. Dixon. He really cares!! He told me to spread his name and number around. He’s seriously building a case on the little weasel! As he said, he can’t say we’ll ever see our money again, but he imagines seeing the evil little ba**ard get his due might make us all feel a little better. I feel better just knowing that someone down there gives a damn! “somemore”, are you the lady from Ohio he spoke to a little while ago?

Yes, I am. I called another lady down in Atlanta who Heath owes thousands
to. I know of at least 4 others who I need to spread the word to tonight.
After I read everything, I guess I could call myself lucky. Heath only
owes me the renter’s deposit and my maintenance fee. My husband and I
drove down to Nashville two months in a row to get our June and July
deposits. I definitely would like to see him get his due as well.

If you have any additional information about Stewart Heath, please share them in the comment section or email me at denised@reallybadboss.com. You might be a really bad boss and a really stupid one if you knew in advance that authorities had been expecting the package, but decided to sell it anyway.

Atlanta based UPS manager turned drug dealer, Anna Wright, was arrested last Friday on charges of making false statements to federal agents. Why that charge? Turns out the 33 year old Wright had previously been alerted by US Postal Inspectors that a certain mail box in her store might receive a package containing contraband. Wright agreed to contact the inspectors if and when the store received the package. But authorities say that instead of alerting inspectors, Wright stole the package containing several pounds of marijuana and sold the drugs for profit.

In addition to selling drugs, Wright is charged with theft and lying to authorities. The charges each carry a maximum sentence of 5 years in prison and a fine of up to $250,000. I hope she made enough from the sale to pay for a lawyer. She’s going to need one.

When the police arrived, they were able to talk Heath into surrendering. Heath was arrested and charged with aggravated assault.

Well, in addition to the usual comments confirming that Heath was as bad as they get, I’ve gotten several comments about Heath flat out stealing thousands of dollars from people. The most recent comment from a reader gave some details about her attempt to involve the authorities:

I beat her so hard I forgot about it? Yeah, ummm, I don’t know Chris.

Yeah, ummm, I don’t know Chris. Really Bad Boss is all about people in charge, taking responsibility for their actions. Parents raising their kids well, politicians honoring their promises to their constituencies (and wives), and entertainers (often role models for legions of teen fans) taking responsibility for their actions.

Like the rest of the country, well the rest of the country who cared, we were pretty shocked six months ago to see the bruises on pop singer Rihanna’s face, and even more shocked to learn they got there as a result of a beating handed down by her just as famous, pop-star boyfriend, Chris Brown. Several court appearances and apologies later, Chris Brown, dressed in baby blue and sporting a bow tie, sits down to an interview with Larry King and says…well, watch it for yourself.

He now says he was shocked when he read the police report and doesn’t really remember the events of the evening. Until the episode airs, we won’t know what else Chris is saying, but it’s hard to imagine not remembering beating someone over an extended period of time while driving through LA, in a rented Lamborghini. I mean, I had a particularly harrowing slap fight with my sister back in ’83 and the event and subsequent trauma is still clear as a bell today. So it’s kind of hard for me to believe Chris Brown doesn’t remember the events of the night in question.

That said, Brown’s not remembering is not the same as him saying it didn’t happen. In fact, Brown has been publicly and privately apologetic since the event. So, is his not remembering a ploy for sympathy, or a real reaction to an incident that was truly out of character for him? Police reports indicate that this wasn’t the first incident of physical abuse between the pair. So the temporary amnesia explanation isn’t as believable when your realize that there might have been a pattern of abuse.

The Larry King interview with Chris Brown is scheduled to Air on Wednesday, September 2nd. We’ll watch to see what Chris says and does, but ultimately, his legions of young fans will be the ones to decided, with their dollars, whether they’ve forgiven Brown’s really bad behavior or not.

I’d never heard of Gregory Malia until recently, but it turns out the priest’s reputation precedes him. Malia, an ex-priest with the Diocese of Bethlehem Episcopal Church, is facing a fraud investigation surrounding his Pennsylvania pharmacy (currently being sued by Blue Cross for improper billing.) But even before that, Malia was notorious for bar and club hopping throughout New York. The priest was well known for tooling around the city in a $75,000 Jaguar and spending his evenings at nightclubs and bars buying magnums of Dom Perignon at $25,000 each and dropping thousands of dollars in tips each night.

That’s excessive behavior for anybody, but a priest? Isn’t there some kind of non-baller clause in their contract? The Episcopal church thinks so. They gave the reverend six months to clean up his partying ways or risk being defrocked. Church elders already suspended him as vicar of his parish in the hamlet of Carbondale last year after he was busted partying at several New York hot spots.

Not satisfied with being known as the partying priest, Malia, taking a page from the idiot professional athlete files, brought a gun into a nightclub back in July and pulled it on his estranged daughters. Talk about fatherly love. Malia’s daughter Marilyn says that women at the club “beat the living hell out of me and my father just stood there and watched and enjoyed it, and protected the girls who beat me.” Nice dad. Father Malia was charged with aggravated assault, reckless endangerment and disorderly conduct following the dustup. No word on whether he is either willing or able to give up his current baller status to retain his priestly duties.

New memoir uncovers alleged 20 year Madoff affair

As recipient of a Really Bad Boss Lifetime Achievement Award, and possibly the worst money manager in the history of money managers, Bernie Madoff is a frequent target topic at Really Bad Boss (see Really bad boss rule#55: When you’re in charge of managing people’s money and you steal it, you’re not allowed to keep it.) So we were hardly able to contain ourselves when we learned through the Associated Press that Bernie Madoff allegedly carried on a 20 year affair with one of his victims. Talk about screwing someone over.

Sheryl Weinstein apparently found Bernie Madoff irresistible in more ways than one. In her newly released memoir “Madoff’s Other Secrets: Love, Money, Bernie and Me,” Weinstein claims the two met at a business event while she was chief financial officer for Hadassah, a charitable women’s organization that also lost money to Madoff’s scheme. While with the organization, Weinstein had a role in investment decisions. Which begs the question, did Weinstein’s relationship with Madoff influence her, and thereby the organization’s decision to invest with the disgraced financier? Better yet, how much of an influence did the relationship have and did it blind her to the truth about Madoff? It certainly blinded Ruth Madoff. Not only is she still claiming ignorance with regard to her husband’s crimes, but through her attorney she’s claiming to know nothing about the “alleged affair.”

Weinstein, who’s been married for 37 years, says she had to sell her Manhattan home and that her investment losses have ruined her family. I imagine the revelation of the affair also had something to do with the ruining the family part. No doubt Weinstein releasing her book is an attempt to make up for some of the financial losses she suffered at the hands of Bernie Madoff. And while we feel sympathy for those losses, she loses quite a few points for carrying on a 20 year affair with a criminal – a married criminal. Her story serves as a precautionary tale, reminding us that when you lie with dogs, you get fleas.

Proving that men don’t own the market on really bad bosses, Alpha Kappa Alpha sorority national president and former Chicago Housing Authority comptroller Barbara McKinzie has amassed a long list of really bad behavior that’s raised the ire of sorority members nationwide. Among the things McKinzie is accused of doing:

Commissioning a $900,000 wax figure of herself

Taking almost $400,000 of organization funds for personal expenses

Arranging for a $4,000 monthly personal stipend to be paid after she leaves office

Using the group’s American Express card to buy designer clothing, lingerie and jewelry, then redeeming points to get among other things, a 46-inch HDTV for personal use.

In her defense, McKinzie says she’s done nothing wrong and that the accusations are retaliation against her for enforcing the organization’s stringent financial standards. She says the wax statue in question along with that of AKA’s first national president, Nellie Quander, cost a total of $45,000 and that the statues are being prepped for display at the National Great Blacks in Wax Museum in Baltimore.

Members are now suing to oust McKinzie for misappropriation of funds. And, despite her denials, it’ll be pretty hard to refute evidence of misusing the credit cards. If the accusations are true, it makes you wonder how well she managed finances as Chicago’s Housing Authority comptroller. I smell an investigation. Members have had issues with AKA and it’s leadership for years, questioning membership dues, registration fees and McKinzie’s compensation. But, this is one of the few times the discord has made it to the national stage.

$900,000 wax statues, excessive personal expenses and misappropriation of organization funds are a serious betrayal of trust to the organizations’ 50,000 active members, and fly in the face of AKA’s ideals of sisterhood, ethics and service. Thoughts?

Get more details on McKinzie and the Chicago chapter’s fight to have her ousted here.

You pull a gun on your employee…after he confronts you…for giving him a bad check. Last Friday the pressures of a mounting FBI investigation and a $1.1 million judgment against him for questionable real estate dealings, got the best of Stewart Heath, CEO of Equity Reality Estate. After two days of FBI agents hauling boxes out of his office and a confrontation with an employee about a bounced payroll check, Heath pulled a gun on the employee. The employee managed to get out of the building and call 911 from the parking lot. When the police arrived, they were able to talk Heath into surrendering. Heath was arrested and charged with aggravated assault.

We’re accustomed to stories about employees seeking revenge on bad bosses. And we’re all for calling employers out when they do things like pimping out employees and bouncing payroll checks. But perhaps getting into a shouting match with your embattled CEO on the same day FBI agents removed boxes of evidence from his office isn’t the best timing. When dealing with a really bad boss, choose your battles and your timing, wisely.

Seattle bank teller fired after chasing and catching bank robber

Jim Nicholson, 30, was fired a day after running down a would-be robber who entered a Key Bank branch near the Seattle Center. The bank, like most banks, has a strict policy outlining appropriate teller behavior in the event of a bank robbery. Tellers are trained to get bank robbers out the door quickly and comply with requests unless they feel their lives are in jeopardy. Nicholson not only ran after the criminal in question, but caught him and held him down until the police arrived. For his part, Nicholson says he understands why he was fired, but says instinct took over. Was the firing the act of a really bad boss or a company concerned with deterring renegade behavior among bank employees? You make the call. Discuss after the jump.

Really Bad Bosses in the pulpit

Last month 76 year old Richard Cunningham and his 52 year old son Philip were sentenced to 2 years in prison for stealing more than $3 million from the California church where they pastored. And the church said amen.

On the books, each earned less than $100k annually. But a private investigation conducted in 2006 found that more than $3 million of church funds were unaccounted for, and that the pair had written personal checks to themselves from those funds. The pastors, not content with waiting for their heavenly riches, decided to get an advance on them to purchase time shares in Hawaii, luxury vehicles and memberships to exclusive clubs. When the theft was uncovered in 2006, a scandal rocked the church and the pastors stepped down. They eventually deeded about $3 million in property to the church to repay the debt. The judge took that into account when determining their sentence.

Philip Cunningham’s daughter said she was proud of her dad, and that “he never meant to hurt anybody.” I disagree. As someone’s who’s had stuff stolen from me, I know it does not feel good to get robbed. It hurts. And the guy who broke into my car to steal my stuff knew I’d be hurt when I found my window busted and my belongings missing, and he didn’t give a damn. Had he cared, he wouldn’t have stolen from me. So, whether you’re wearing street clothes, a governor’s suit, or a priest’s collar, when you willfully and intentionally steal from people, you mean to hurt them. You never mean to get caught. And you don’t mean for your victims to be mad at you when you do get caught. But hurt them, yeah, you meant to hurt them. Source

Drugs, tax evasion and now stalking? Marion Barry determined to remain Really Bad Boss icon

Not content with being remembered as the mayor caught on tape smoking crack, former DC mayor Marion Barry was arrested last Saturday night for allegedly stalking a female companion. The woman who made the complaint dined with Barry earlier in the day, but apparently he was still hungry when he saw her again later that day at a July 4th celebration. The woman flagged police officers down as she was driving and told them that Barry was chasing her in another car. Barry was charged with misdemeanor stalking and released. In fairness to Barry, he had not been smoking crack at the time of his arrest, although he is still on probation on federal charges resulting from him not paying his taxes EIGHT TIMES IN NINE YEARS.

Marion Barry deserves a Really Bad Boss Lifetime Achievement Award for his political contributions. In fact, we might give him two. He set the bar for really bad political behavior which the likes of Blagojevich and his ilk have spent their entire political careers desperately attempting to fling themselves over. You may remember Barry, who in 1990 was famously caught on tape smoking crack. As is par for the course with politicians, he initially denied wrong doing, and then claimed he’d been set up (because apparently it’s really easy to get a sitting mayor, who claims he’s never smoked crack to smoke crack, if you just ask him if he wants some…and hand him a lighter.) After serving six months in federal prison, the mayor was actually reelected in 1994, going on to serve as mayor through 1999. Seriously. It even says so in Wikipedia, and as a backup source, I’m old enough to remember it. During his tenure, crack became DC’s state flower (ok, I made that part up.)

Barry’s spokesperson, Natalie Williams, said Barry was unavailable for comment on Sunday because he was in church all day. We’re taking up a collection to help him lease an entire pew and a VIP parking spot at the church. He needs them.

You can read more about Barry’s arrest here. Submit your nominees for The Really Bad Boss Lifetime Achievement Award in the comment section after the jump.

Giant Labor Solutions has been charged with among other things, alleged racketeering, forced labor trafficking, wire fraud and money laundering. In light of the recent auto industry fiasco and labor unions’ seeming unwillingness to make the compromises necessary to stave off massive layoffs, it’s easy to decry unions in general. But the cold hard fact is many companies won’t do the right thing, unless and until they’re forced to. Read more at Today’s Workplace.

Our favorite Ponzi schemer and new recipient of a Really Bad Boss Lifetime Achievement Award was sentenced to 150 years in prison today. Our only disappointment with the sentence is that Madoff will die pretty early into it, won’t be able to really experience the joys of prison life, and won’t actually get to see his award. His wife in the meantime, has forfeited a reported $80 million assets, leaving her with a paltry $2.5 million. Our heart goes out to her.

One of the worst things about Madoff and his wife is that, with the exception of a canned statement today during sentencing, they haven’t expressed any real remorse over what they’ve done. In fact, Mrs. Madoff insists she’s “betrayed and confused” by her husband’s actions.

The sociopathic pair not only robbed and lied to individual investors, but they also scammed charity organizations, close friends and family members. Even their own children aren’t talking to them. If sociopathic behavior over a span of decades doesn’t qualify you for a Really Bad Boss Lifetime Achievement Award, I don’t know what does.

And we thought we had it bad. The EEOC has filed a case against Willamette Tree Wholesale, operator of 140 acres of retail nursery farmland near Molalla. The company allegedly ignored reports of sexual harassment and rape, and then retaliated against the workers who filed the reports. One 38 year old female was reportedly taken to remote areas of the property by the company foreman and raped repeatedly over a period of several months. According to the EEOC, the investigation found that predatory sexual behavior at the nursery was rampant, “expected…and a condition of employment.”

What makes this case even more shocking are claims that the problem is a national one. Migrant workers are largely undocumented individuals who, because they’re in the country illegally, underreport crimes committed against them. EEOC lawyer William R. Tamayo says workers refer to fields in California as fields of “calzon,” or “panties” and in Florida as “The Green Motel.” According to them, sexual harassment is par for the course for farm workers and complaints are the exception and not the rule.

While individuals who are in this country illegally are committing a crime, the people committing crimes against them are no less criminal. They’re just citizen criminals. And, the sexual harassment, rape and mistreatment of migrant workers will continue as long as the majority of the workers are here illegally. It’s a vicious, sad and ironic cycle that in being here illegally, the victims of these crimes don’t have access to one of the basic rights of American citizenship and that’s the right of protection.

The topic of how to deal with illegal immigration can be debated until the cows come home. But what isn’t up for debate is that employees, regardless of their citizenship, should not be subject to working conditions that include rape and torture. By hiring undocumented workers, companies like Willamette compound their criminal activities by adding sexual assault to their list of crimes. Tamayo says he hopes the “lawsuit will send notice to employers in [the] industry to stop predatory sexual behavior and abuses of supervisor power.” We hope so, but the cynic in us believes that as long as there are victims too afraid to report abuse, there will be employers like Willamette looking to take advantage of them. Source: Oregon AP

CEO of youth Anti-Drug organization busted

Really Bad Boss was created with people like this in mind. Kendall Craig Farris, founder and really bad CEO of the California based ‘Over the Wall Foundation’, an anti-drug abuse youth organization, was charged last Thursday with…wait for it…dealing drugs. In a classic case of do as I say, not as I do, Farris, whose self described mission is to “help youth, schools, and families prevent drug and alcohol abuse before it starts…” was busted selling $480 worth of methamphetamine and Ecstasy to an undercover officer. In an ironic twist, what Farris was trying to pass off as meth and Ecstasy was actually rock salt and antihistamine. Rock salt and antihistamine. So, Farris is about to serve time for potentially treating someone’s anemia and allergies.

It gets better. When Farris was busted, he had in his possession, paperwork from school officials thanking him for a recent anti-drug presentation. In an ironic pile-on, if he ends up serving time, his organization’s name ‘Over the Wall’ takes on a brand new meaning. Source: The Daily Breeze

In addition to the sex, Tipler is accused of altering evidence, causing a witness to unknowingly give false testimony and charging clients excessive fees. We never thought we’d have to create a rule for this one, but here goes. This one actually calls for part A & B. Really bad boss rule #83A – If you’re an attorney, don’t pimp your clients for sexual favors. Really bad boss rule #83B - If you’re an attorney and you pimp your clients for sexual favors, don’t become their John.
